Contractual & Claims Advisory

Contractual claims that stand up to scrutiny.

Practical, evidence-led contractual and claims advice for contractors, developers and project teams, from early notices and variations to payment recovery, final accounts and formal disputes.
Overview

Protect your position before issues escalate.

Contractual entitlement is only part of a successful claim. The relevant notices, factual records, programme evidence and financial substantiation must also tell a consistent story. We help clients identify the issues that matter, understand the strengths and limitations of their position and decide on a proportionate course of action.

Led by John Leong, Executive Advisor – Contractual, Quantum & Dispute Resolution, our contractual and claims support covers contract administration, claims strategy, variations, payment claims, extensions of time, loss and expense and final accounts. Where a matter requires detailed delay analysis, the work can be coordinated with Sam Nason's programming and forensic delay specialism.

Advice can be provided for a single claim, at critical project milestones or through an ongoing project or portfolio retainer. Early involvement is particularly useful where contractual deadlines, payment exposure or an emerging dispute require timely decisions.

We support commercial and technical claim preparation and work alongside legal counsel where legal advice, statutory adjudication or formal proceedings are involved. Any engagement is subject to scope, independence and conflict checks.

Frequently asked questions

Practical answers before the engagement begins.

When should we engage a contractual claims adviser?
Ideally before a contractual notice or payment deadline is missed. Early review can help preserve rights, identify missing evidence and deal with change while the relevant records and project personnel are still available. We can also review established claims and disputes.
Can you prepare and assess claims, rather than simply advise on them?
Yes. Subject to an agreed scope, we can prepare or review contractual and commercial claim submissions, assess entitlement and supporting evidence, and coordinate programme and quantum inputs. The work is tailored to the contract and intended audience.
Can you assist with payment claims and SOPA adjudication?
We can assist with the commercial and quantum aspects of payment claims, payment disputes and adjudication preparation, including valuation and evidence reviews. Statutory requirements and legal representation should be addressed with appropriately qualified legal counsel, particularly where deadlines are imminent.
What if a claim involves both delay and additional cost?
Contractual entitlement, time causation and cost valuation should be assessed together, while remaining analytically distinct. John can address contractual and quantum questions, with Sam providing specialist programming, EOT, disruption and forensic delay analysis as needed.
Do you offer ongoing support across more than one project?
Yes. A project or portfolio retainer can provide continuity across notices, variations, payment matters, programme issues and emerging claims. This is often more efficient than commissioning separate reviews after positions have already hardened.
